SHORT-TERM RENTAL CONTRACT

FOR

SUNNY DAYZ OASIS

RECITALS


This Short-Term Rental Contract (“Agreement”) is dated and executed on _____________ (“Effective Date”), between Sunny Dayz Oasis (“Host”), a Michigan LLC, and _________________________ (“Guest”), collectively “the Parties.” Guest seeks to lease and Host seeks to rent a short-term vacation property.


The Parties hereby agree as follows:


ARTICLE ONE:
IDENTIFICATIONS


1.1 Location of Rental Vacation Home.

Guest will be leasing the following property (“Premises”):

ARTICLE TWO:
RENTAL TERMS


1.3 Rental Period.


Check-in Date:

Check-out Date:


(a) Check-in / Check-out Times. Check-in shall be no earlier than 4:00 PM on the above check-in date, and check-out shall be no later than 10:00 AM on the above check-out date.


(b) Additional Fee. Host reserves the right to charge an early check-in fee and a late check-out fee at Host’s discretion.


(c) Extension of Rental Period. Guest may request to add additional days, for an additional fee, onto their Rental Period subject to Hosts approval.


1.4 Rent.


Rent shall be due and paid in full immediately upon signing. The rental amounts due exclude city, county, and state taxes and fees. Such taxes and fees later be calculated.

1.5 Fees and Security Deposit. Guests agree to the following fees, which are due immediately upon signing:

ARTICLE THREE:
GENERAL PROVISIONS


1.7 Cancellation Policy.


(a) Cancellation by Guest. (i) Guest may cancel their reservation sixty (60) days prior to their check-in date for a full refund minus deposit. (ii) If Guest cancels the reservation less than sixty (60) days prior to their check-in date, no refund shall be issued.


(b) Cancellation by Host. In the unlikely event that the Host needs to cancel the reservation, the Guest will receive a full refund of all actual amounts paid by Guest to Host. Host shall have no obligation to find alternative accommodations.


(c) Early Departure. Guest shall not receive any refund for early departure.


(d) Guest No-Show. If the Guest does not arrive on the scheduled check-in date and time and has not informed the Host of a delay or change in plans, the reservation will be considered a no-show and abandoned by Guest. No refund will be issued and Host may re-open the Premises for rent by another guest.


(e) Extenuating Circumstances. In the event of extenuating circumstances, (such as, but not limited to, natural disasters, governmental travel restrictions, acts of God, destruction of the Premises, etc.) Host and Guest will make reasonable efforts to agree on a fair resolution, which may include rescheduling the stay, making accommodations for an alternate premises, or a partial or full refund.


(f) Reservation Changes. Any changes to the reservation, including shortening the stay or changing the dates, are subject to availability and the Host’s approval. Additional charges or fees may apply for changes.


(g) Refund Processing. Refunds, when applicable, will be processed within seven (7) days from the date of notice to Host.


1.8 Maintenance and Repair.


Guest shall:


(a) Maintain the Premises in a condition substantially the same as when they checked-in;


(b) Leave the Premises in a broom swept condition, and all furnishing shall be placed back in the location as they were upon arrival;


(c) Not use the Premises in an unlawful manner;


(d) Immediately notify Host of any necessary repairs;


(e) Pay an additional fee for any extra-ordinary maintenance, repairs of the Premises by deduction of the security deposit;


(f) Pay additional fees for any loss and replacement of personal property provided by Host by deduction of the security deposit;


(g) If damages exceed the security deposit, guest agrees to pay the overage.


Host shall:


(g) Provide the Premises in a good, clean, and ready-to-rent condition;


(h) Pay for any normal wear and tear on the Premises;


(i) Charge Guest and provide receipts for extra-ordinary maintenance or repairs of the Premises, including the fair market value of labor and costs of goods purchased.


1.9 Palm Key Village & Vista Del Lago Requirements.


Palm Key Village and Vista Del Lago require, and Guests agree to, a background check and pet approval. Guests shall pay for any costs associated with these background checks and pet approvals.


1.10 Insurance.


(a) Guest expressly recognize that any insurance claims for personal property or loss which the Guest incurs would be the Guest’s sole responsibility and is not the responsibility of Hosts property insurance;

(b) Guests should purchase their own insurance for either or both Guests and Guest’s visitors personal property.


1.11 Indemnification / Liability Waiver.


Guest will indemnify and defend Host against all claims for bodily injury or property damage relating to the Premises. The claims covered by this indemnification include all claims for bodily injury or property damage relating to


(a) the condition of the Premises;

(b) the use or misuse of the Premises by Guest or its agents, contractors, or invitees; or

(c) any event on or within the Premises, whatever the cause. Guest’s indemnification does not extend to liability for damages resulting from the sole or gross negligence of Host or from Host’s intentional misconduct.


1.12 Internet.


High speed wireless internet is provided as a convenience only and is not integral to this Agreement. No refund of rents shall be given for outages, content, lack of content, or speed access, problems, lack of knowledge of use, or personal preferences with regard to internet services.


1.13 Television.


The TV and the level of service is provided and chosen by the property owners. No refund of rents shall be given for outages, content, lack of content, or personal preferences with regard to the TV service. If the guest choses to want a higher level of service than what is provided, they may opt to pay for the additional costs related to increases. The additional costs must be paid within the first 1 week of service for long term rentals. The service will be stopped and not restarted for lack of payment. For short term stays the guests must pay Sunny Dayz Oasis for any desired additional TV service.


1.14 Home Manual.


The property owner provides an electronic and a physical hard copy of the Home Manual. The electronic version will be sent to the guests upon payment of the deposit. The physical hard copy is placed in the vacation home for quick referencing. The Home Manual has several pages of information necessary to the operation of the home during the guest’s stay. The Home Manual becomes part of the full agreement of this document. Any questions regarding the specific property and/or Home Manual information may be directed to the Hosts/property owners before signing if so desired.


1.15 Attorney Fees.


Guest shall pay all costs and attorney’s fees and expenses arising out of a breach of this Agreement.


1.16 Sublets and Assignments.


Guest must not assign this Agreement or sublet the Premises without the prior consent of Host, which may be withheld in Host’s sole discretion. Any assignment or sublease of the Premises without Host’s consent is void.


1.17 Holdover.


(a) Holdover Without Host’s Agreement. If the Guest remains in possession of the Premises after the check-out date and time without the Host’s express written consent, such holdover shall create a tenancy at sufferance. The Guest shall pay to the Host a daily rent of $________ for each day Guest remains in possession without Host’s consent. Host may, at its option, treat Guest as a trespasser and pursue all available legal remedies, including eviction and recovery of damages.


(b) Holdover With Host’s Agreement. If Guest desires to remain in possession of the Premises after the check-out date and time, the Guest must request an extension of this Agreement at least two (2) days prior to the check-out date and time. Host, at Host’s sole discretion may grant or deny this request. Should Host agree, the extension will be subject to the same terms as this Agreement.


1.18 Entry of Host.


Host or Host’s agents may enter the Premises, with reasonable advance notice to Guest, in order to perform any necessary repairs or provide replacement furnishings.


1.19 Severability.


If any provision of this Agreement is invalid, that provision shall be disregarded, and the remainder of this Agreement shall be construed as if the invalid provision had not been included.


1.20 Choice of Law.


This Agreement is to be interpreted and construed under Florida law, without regard to conflict of law principles.


1.21 Captions.


The captions appearing in this Agreement are for convenience of reference only, and shall be disregarded in determining the meaning and effect of the provisions of this Agreement.


EXECUTION


By signing this Agreement, Guests indicate a full understanding and agree to follow the terms of this Agreement.
